GENERAL TERMS AND CONDITIONS OF USE OF THE LOYALTY PROGRAM MY BLEND MY+

This General terms and condition of use of the loytaly program myBlend my+ was updated on [16th of May 2022].

The present general conditions govern the contractual relations applicable between MY BLEND and its members in the context of the operation of the “my +” loyalty program.

1. Subject

The “my +” Loyalty Program is offered by MY BLEND, a one-person simplified joint stock company with a capital of €2,150,000, registered with the Nanterre Trade and Companies Registry under number 449 848 803, whose registered office is located at 9, rue du Commandant Pilot – 92200 Neuilly sur Seine, France.

The purpose of the “my +” Loyalty Program is to allow its members (“Members”) to benefit from specific advantages and services by accumulating points when purchasing MY BLEND brand products (the “Products”) at “La Maison myBlend ” or on the MY BLEND website as identified below and MY BLEND skincare services at “La Maison myBlend” as well as when using a MY BLEND gift card at “La Maison myBlend” or on the MY BLEND website as identified below. MY BLEND brand products (the “Products”) at “La Maison myBlend” or on the MY BLEND website as identified below, and MY BLEND skincare services at “La Maison myBlend” and when using a MY BLEND gift card at “La Maison myBlend” or on the MY BLEND website as identified below.

The eligible points of sale for the operation may be updated by MY BLEND at any time. Members will be informed as soon as possible.

It is specified that any purchase made in another point of sale than those mentioned above are not eligible for this operation.

These terms and conditions, to which the applicant has had prior access before joining the loyalty program, are deemed to be approved without restriction by the Member upon joining the “MY +” Loyalty Program.

2. Membership in the my+ loyalty program

The loyalty program “MY +” is open to any person of legal age, residing in one of the following countries delivered by the e-commerce site www.my-blend.com:

Australia, Austria, Belgium, Bulgaria, Canada, Cyprus, Czech Republic, Denmark, Egypt, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Mexico, Morocco, Netherlands, Norway, Poland, Portugal, Qatar, Romania, Saudi Arabia, Singapore, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Arab Emirates, United States.
The program is open to employees of the Clarins group, including those of the myBlend brand.

The applicant must have a personal account on www.my-blend.com and give his consent to become a Member of “my +”.

If the applicant does not have a personal account and wishes to become a Member, he/she must fill out the registration form on www.my-blend.com and then check the box “Subscribe to the loyalty program”.

If the applicant already has a personal account and wishes to become a Member, he/she must connect to it on the site www.my-blend.com select the heading My account and then click on the button at the bottom of the page “Become a Member”.

No application for membership in the loyalty program will be considered by phone, mail or e-mail.

In order to benefit from the advantages of the “my +” loyalty program, the applicant is invited to communicate the following data from his/her personal account on the www.my-blend.com website under the headings My account / Personal information: title, first name, last name, date of birthday, valid e-mail address and postal address.

The Member guarantees the accuracy of all information provided throughout the membership. Any inaccuracy could impact the proper processing of the Member’s benefits for which MY BLEND cannot be held responsible. MY BLEND reserves the right to request at any time the presentation of any document allowing the identity of the person wishing to subscribe or having subscribed to the “my +” Loyalty Program to be proven, notably in the case of homonymy.

Any change must be notified as soon as possible by the Member from his/her personal account on the website www.my-blend.com under the headings My account / Personal information or to MY BLEND Customer Service via the following email address: customercare@my-blend.com.

Membership in the “MY +” Loyalty Program is effective as of the validation of the membership form by MY BLEND. Once the membership has been validated by MY BLEND, the Member will be able to accumulate loyalty points and have access to rewards from the first purchase of Products, MY BLEND care services or use of a MY BLEND gift card made in the physical point of sale or on the website mentioned in article 1 of the present general conditions of use. Membership is nominative, personal and reserved for individuals for their own non- professional use. The ” MY + ” loyalty program includes a personal identification number that is assigned to the Member. It is strictly individual and nominative. Each client can only subscribe to one membership and can only have one account in their name. If MY BLEND finds that a person has more than one loyalty account, MY BLEND reserves the right to terminate the Member’s account, which will result in the deletion of all points and benefits accrued.

MY BLEND reserves the right to refuse or terminate the membership of any person who does not meet the conditions defined in the present general conditions of use of the “my +” loyalty program.

In accordance with the legal provisions in force, the rules of membership in the “my +” Loyalty Program are valid for an unlimited period of time as soon as the Member makes or declares at least one purchase of MY BLEND Products, skincare services or uses a MY BLEND gift card in the physical point of sale or on the website mentioned in article 1 of the present general conditions of use over a period of three years. The Member is however entitled to stop participating in the “my +” Loyalty Program at any time by notifying MY BLEND Customer Service of his/her decision to close his/her account.
When an account is closed, the points counter is reset to zero and unused points, benefits and rewards not yet ordered, delivered or issued are definitively lost, even in the event of a new subscription by the Member.

3. myBlend loyalty program benefits

3.1. CUMULATIVE POINTS

Membership in the “my +” Loyalty Program allows the Member to accumulate points when purchasing Products, MY BLEND care services or using a MY BLEND gift card in the physical point of sale or on the website mentioned in article 1 of the present general conditions of use. The points are automatically credited at the time of one of these actions without the Member having to complete any other formalities.

The modality applicable to the calculation of points is as follows:

1 € spent when purchasing a Product, MY BLEND care service in eligible points of sale as mentioned in article 1 of the present general conditions of use, using a MY BLEND gift card, or any other type of purchase giving access to points (such as the purchase of a gift box) = 1 “my +” point earned.

Points are valid for 1 year from January 1er of each calendar year until December 31 of the same year, except for the exceptions mentioned below.

At each calendar year change, on January 1, the point counters are reset to zero, with the exceptions noted below. Unused points cannot be recovered. They are automatically donated by MY BLEND to the Association “La Maison des Femmes” as presented on the presentation page of the “my+” program at www.my-blend.com

The Member will be notified by two communications by e-mail at least 2 months before the expiration of his points. A final e-mail will notify the Member that his or her points balance has been effectively reset to zero and the amount converted into points donations if any points remain. Two exceptions are made:

  • In 2022, for the first year of the launch of the “my +” Loyalty Program, the points accumulated at launch (May 2022) are valid until December 31 of the following calendar year, i.e. December 31, 2023.
  • For all other years, the points accumulated during October, November and December of the current year are valid until December 31 of the following calendar year.

The Member may consult his or her points balance at any time by logging into his or her personal account on the www.my-blend.com website under the heading My Account, it being specified that the online counters are updated in real time. The Member also has the possibility to dematerialize his loyalty card in his mobile “Wallet” on iOS or Android. To do so, the Member must go to the My Account / My Loyalty Card section and scan the QR Code presented.

In the event of a dispute over the number of points accumulated, only the information contained in the MY BLEND database will be considered authentic.

3.2. ONGOING BENEFITS OF THE PROGRAM

The ” my + ” loyalty program offers all its members several advantages as soon as they join the program:

  • Upon joining the “my +” loyalty program, the Member will receive a welcome gift from MY BLEND. The gift is a kit including, subject to availability: a Vanity and 2 Oshiboris (towels). This gift will be added to the first order placed by the Member and sent to the address provided by the Member at the time of his/her first purchase. Shipping costs will be covered by MY BLEND. This welcome gift will be delivered as soon as possible by MY BLEND. MY BLEND reserves the right to modify the nature of the welcome gift at any time.
  • For his birthday, the Member will benefit from a promotional offer. This offer will take the form of a 15% discount coupon valid on the next order made by the Member during 30 days of his birthday, without any minimum purchase price condition. The Member will be informed of the offer by sending e-mails to the e-mail address indicated in his or her My Account / Personal Information space. The coupon must be used on the website mentioned in article 1 of these general terms of use. This offer is conditional upon the Member communicating his/her birthday on the website www.my-blend.com in the My Account / Personal Information section. MY BLEND reserves the right to modify the percentage of the coupon at any time.
  • The Member will have preview access to new MY BLEND Products or Care Services. The Member will be informed of new MY BLEND products and services by sending emails to the email address provided in the My Account / Personal Information section. The Member may also have access to new products via the My Account / Preview section.
  • The Member will benefit from exclusive communications in the form of emails sent once or several times a year to the email address entered in the My Account / Personal Information section. The nature and recurrence of the communications will be at the discretion of MY BLEND. However, in accordance with article 7 of the present general conditions of use, the Member, while maintaining his/her membership status, may request to stop receiving any communication from MY BLEND.

3.3. REWARD LEVELS AND USE OF ACCUMULATED POINTS

The ” my + ” Loyalty Program distinguishes several levels according to the number of points accumulated by the Member following his or her purchase of MY BLEND products or services or use of a MY BLEND gift card in the physical point of sale ” La Maison myBlend ” or on the website mentioned in article 1 of the present general conditions of use. When the Member reaches a level he/she can choose:

  • Use his/her points to purchase MY BLEND product(s) from the selection of products presented on his/her account in the [Redeem my points] section. The points used to purchase the MY BLEND product(s) will be deducted from the Member’s balance. The Member will only be able to return a MY BLEND product purchased with points if the product is altered or expired. In this case, the Member must report the alteration of the product to the following address customercare@my-blend.com within five (5) days of receiving the product. If these conditions have been respected, MY BLEND undertakes to return the same unaltered product to the Member, at his/her expense.
  • Donate your points to the association “La Maison des Femmes”. The points used will then be deducted from the balance. In this case, for every 10 points donated MY BLEND will make a financial contribution of 1€ to the association.
  • To continue to accumulate points to reach the next level. These points have no monetary value, cannot be exchanged or refunded and can only be used within the framework of the ” my + ” loyalty program.

The levels are as follows:

  • Level 1: as soon as 700 “my +” points are accumulated, the Member can choose 1 free product from the selection of MYBLEND products in Basket 1 or donate his or her points to the association “La Maison des Femmes” for a value of 70€.
  • Level 2: as soon as 1000 “my +” points are accumulated, the Member can choose 1 free product from the selection of MYBLEND products in the Basket 2 and donate his/her points to the association “La Maison des Femmes” for a value of 100€.
  • Level 3: from 1300 “my +” points accumulated, the Member can choose 1 free product from the selection of MYBLEND products in Basket 3 or donate their points to the association “La Maison des Femmes” for a value of 130€.
  • Level 4: as soon as 1600 “my +” points are accumulated, the Member can choose 1 free product from the selection of MYBLEND products in Basket 4 or donate his or her points to the association “La Maison des Femmes” for a value of 160€.

Each level allows the Member to benefit from a product offered in sale format from a selection of MY BLEND products or to donate points to the association “La Maison des Femmes”.

Selections of MY BLEND products and point donation coupons corresponding to each tier can be viewed at www.my-blend.com on the my + / Your Loyalty Program page or from a personal account under My Program / Redeem My Points.

MY BLEND reserves the right to change the various award selections at any time.

For each donation of points made, MY BLEND commits to systematically donate 50% of the amount of the associated value to the association “La Maison des Femmes”. For example, for each donation of points corresponding to a value of 70€, MY BLEND will donate an additional 35€ to the association for a total financial contribution of 105€.

MYBLEND reserves the right to modify at any time the percentage of the additional amount it donates to the association “La Maison des Femmes”.

All the points donated by the Members will be transformed into a financial contribution paid annually by MY BLEND to the association “La Maison des Femmes”.

In addition, if the total amount of points donated by Members does not reach an annual financial contribution of ten thousand euros (€10,000) paid by MY BLEND to the association “La Maison des Femmes”, MY BLEND will provide to the association an additional financial contribution to reach the amount of €10,000.

If the total amount of points donated reaches an annual financial contribution of 10,000€ or more, MY BLEND will not make any additional financial contribution to the association.

3.4. PROMOTIONS AND COMMERCIAL OFFERS

The ” my + ” Loyalty Program also allows the Member to benefit from specific advantages and commercial offers such as invitations to private sales or events.

MY BLEND reserves the right to target the sending of its commercial offers to a part of its Members.

4. How “my+” works

4.1. METHODS OF DECLARING THE PURCHASE OF PRODUCTS IN THE APPROVED PHYSICAL OR VIRTUAL SALES OUTLETS ELIGIBLE FOR THE OPERATION

1/ Purchases of Products or care services or use of a MY BLEND gift card in the physical point of sale mentioned in article 1 of these general conditions of use:

The Member’s account is credited within 24 hours with the number of points corresponding to his purchases.

2/ Purchase of Products or care services or use of a MY BLEND gift card on the website mentioned in article 1 of the present general conditions of use:

The Member’s account is automatically credited with the number of points corresponding to his/her purchases.

4.2 TRIGGERING A REWARD OR POINT DONATION TIER

To redeem loyalty points, Members must log in to their personal account at www.my-blend.com and select My Account / Redeem Points.
From 700 accumulated points, the Member can choose among the selection of gifts which is proposed to him. They can also choose to donate their points in the form of a coupon to the association “La Maison des Femmes”. Finally, he/she can also decide to continue to accumulate points in order to reach the next levels.

Rewards are shipped to the delivery address provided by the Member when sending the gift. Rewards are shipped at the Member’s expense unless the Member chooses to receive the gift along with an order of Products and that the minimum amount for free shipping is reached. Shipping costs and delivery times for rewards vary depending on the country of shipment and the delivery method chosen.

When the Member decides to donate his or her points, a confirmation email is sent to him or her to indicate that his or her donation of points has been acknowledged. Each year MY BLEND transfers to the association “La Maison des Femmes” the financial contribution that corresponds to the total value of the points donated by the Members during the year.

Once a reward order is validated, it is no longer possible for the Member to modify the choice of gift, or the delivery address entered.

5. Duration of membership in the loyalty program – termination terms

If a Member wishes to terminate his or her membership in the Loyalty Program, he or she may do so by contacting MY BLEND Customer Service at and sending an email to the following address: customercare@my-blend.com

Any fraud, suspicion of fraud, misuse and/or non-compliance with the present terms and conditions and in particular in the case of fraudulent, abusive, misappropriated use, an abnormally high number of transactions or more generally any breach of the present terms and conditions of use may, at MY BLEND’s discretion, result in the definitive termination of the loyalty program with the blocking of the loyalty account and the loss of all rights and benefits attached to it, without entitlement to any compensation. In order to avoid any risk of fraud in the use of the loyalty account, MY BLEND has put in place permanent means of control and surveillance.

6. Evolution of the loyalty program

MY BLEND reserves the right, at any time, to cancel, replace or modify all or part of the “my
+” Loyalty Program and the benefits and services offered thereunder.

In the event of a modification impacting the point counters and/or rewards, MY BLEND will inform Members of these changes by the means it deems most appropriate (posting on the website, postal mail, e-mail, SMS, etc.) within a reasonable period of time prior to the implementation of said modification. Failure to do so within this period will result in the loss of these benefits.

7. Personal data

MY BLEND, a one-person simplified joint stock company with a capital of €2,150,000 registered with the Nanterre Trade and Companies Register under number 449 848 803, whose registered office is located at 9, rue du Commandant Pilot – 92200 Neuilly sur Seine, France, is responsible for processing personal data for the “my +” loyalty program.

The information collected within the framework of the “my +” Loyalty Program on the website www.my-blend.com or by the MY BLEND Customer Service (in writing via the following email address: customercare@my-blend.com), is processed electronically in order to process the Member’s requests, to allow him/her to benefit from the advantages of the “my +” Loyalty Program, to send offers, news and personalized advertisements according to his/her previous purchases and/or interests and to carry out statistics and studies.

This information is kept by MY BLEND for no longer than is necessary for the purposes for which it was collected. In any event, this information is deleted once the Member has not made a purchase or clicked on a hyperlink contained in an e-mail sent by MY BLEND for a period of 3 years.

In accordance with the regulations in force, the Member has a right of access, rectification, deletion and portability of the information concerning him or her, as well as a right of opposition and limitation of processing. They may also formulate directives concerning the conservation, deletion and communication of their personal data after their death. In order to exercise these rights, the Member must send his or her request with proof of identity to the following e-mail address: customercare@my-blend.com. The Member may also lodge a complaint with the competent supervisory authority in charge of data protection or lodge a legal appeal if his or her data is misused.

8. Responsibility

MY BLEND is exonerated from all responsibility for any consequence, direct or indirect, of any anomalies or malfunctions of the “my +” Loyalty Program, regardless of their cause. In the event of malfunction or anomalies, MY BLEND undertakes to maintain the benefit of the Member’s accumulation of points and/or minutes or an equivalence.

The Member declares that he/she is fully aware of the intrinsic characteristics of the Internet and in particular of the fact that the transmission of data on the Internet is only relatively reliable, as the data circulates on heterogeneous networks, with diverse characteristics and capacities, which are sometimes saturated at certain times of the day and which can have an impact on download times or accessibility to data, and that the Internet is an open network, that consequently, the information it carries is not protected against the risks of detour, intrusion into its system, piracy of the data, programs and files of its system, contamination by computer viruses, and that it is up to him to take all the appropriate measures so as to protect the data, files or programs stored in its system against contamination by viruses as well as attempts at intrusion in its system.

Any breach by the Member or a third party acting on behalf of the Member, of the general terms and conditions of use of the MY BLEND “my +” Loyalty Program, any abusive or fraudulent use of the benefits it provides, any falsification of information communicated to MY BLEND as well as any behavior by the Member that is detrimental to the interests of MY BLEND will automatically result in the Member’s deregistration from the “my +” Loyalty Program The Member is informed that the service providers involved in the “my +” Loyalty Program have their own solutions for analyzing, detecting and reporting anomalous or inconsistent actions. If necessary, access to a Member’s space may be suspended or cancelled. The cancellation or termination of an account will result in the loss of the rights attached to the membership, in particular the balance of points and/or minutes, without the Member or any third party or rightful claimant being able to claim any compensation.

9. Partial invalidity – modification of the general conditions of use

If one or more provisions of these terms and conditions are found to be unlawful or invalid, such invalidity shall not render the remaining provisions of these terms and conditions invalid. MY BLEND reserves the right to adapt or modify these terms and conditions at any time and without prior notice, such adaptations or modifications being applicable to any use of the loyalty program after such adaptations or modifications.

10. Disputes – applicable law – competent jurisdiction

The present general conditions are subject to the application of French law. Only the French version of these general conditions of use of the loyalty program “my +” is authentic. Any dispute arising from the interpretation or execution of these terms and conditions and its consequences will be brought before the competent courts.

11. Mediation

The Member is informed of the possibility of having recourse to consumer mediation for any disputes that may arise in relation to the use of the “my +” loyalty program. Referral to the mediator is only possible if the Member has already contacted MY BLEND Customer Service and has not obtained a response or satisfaction to his/her complaint.

The Member may refer the matter to the Paris Mediation and Arbitration Center (CMAP) either by using the form available on the website www.cmap.fr, or by e-mail to consommation@cmap.fr, or by post to the following address CMAP – Service Médiation de la consommation, 39 avenue Franklin Delano Roosevelt, 75008 Paris.

The European Commission also offers a one-stop shop for consumers and professionals wishing to resolve disputes arising from online transactions out of court.
